Convicted of killing her after raping a 10-year-old girl in Dehradun, the court of Special Poxo Judge Rama Pandey has been sentenced to death. According to the prosecution, this is the first case in Poxo court so far, in which the court has written the judgment in 68 pages. Along with this, the court has ordered the District Magistrate to give Rs one lakh to the family of the deceased under the ‘Victim Assistance Scheme in Uttarakhand Crime’.

In July 2018, a case was filed at Sahaspur police station against Jaiprakash resident Village Nemka Purva Mouza Bawa, Thana Kumarganj, Faizabad (now Ayodhya), Uttar Pradesh for raping, murdering and concealing the dead body of a 10-year-old girl. In just 13 months, the court convicted the accused on Monday and fixed Wednesday for the verdict.

On behalf of the prosecution, government advocate Bharat Singh Negi and Saurabh Duseja, on behalf of the victim’s family, argued the case and produced 17 witnesses. Scientific evidence was also an important basis for conviction in this case, including the head hair of the accused, vaginal swab and fingerprints of both of them on a 10 rupee note. On Wednesday, the court sentenced the convict to death.

Punishment in various streams
Section 6 of Protection of Children from Sexual Offenses Act-2012 (POCSO): Life imprisonment and fine of Rs 20 thousand. Out of this, 10 thousand will be given to the family of the deceased. Additional rigorous imprisonment of two years for non-payment of a fine.

Section 302 of Indian Penal Code: Death penalty and a fine of Rs. 30 thousand. 15 thousand rupees will be given to the family of the victim. Two years of rigorous imprisonment for non-payment of a fine. Section 201 of Indian Penal Code: Five years rigorous imprisonment and fine of five thousand rupees. Additional imprisonment for six months for non-payment of a fine.

This was the whole matter
The 10-year-old daughter of a family living near the engineering college in Sabhawala suddenly disappeared. When the family asked the nearby children, it was found that a person had called her to her hut room by luring Rs 10.

When the family saw there, the girl could not be found. On this, he informed the police, and the police started investigating the room. After some time, the body of the girl was found in the room under some sacks and pieces of clay and brick. Police immediately arrested the accused Jayaprakash.
