Laws need to be reformed according to the time and needs of the people – CJI Ramana

Chief Justice of India, Justice NV Ramana on Saturday said the legislature needs to re-look at the laws and reform them according to the times and needs of the people so that they match the practical realities.

Inaugurating the new building of the Odisha State Legal Services Authority in Cuttack, the CJI said that the executive and the legislature need to work together to realize the constitutional aspirations.

Justice Ramana said that I emphasize that our laws should match our practical realities. The executive should make the relevant rules simple and enforce them.

He also emphasized that it was important for the executive and the legislature to work together in realizing the constitutional aspirations.

The CJI said only by doing so the judiciary would not be compelled to step in as a law-maker and would be left with the duty of only enforcing and interpreting the laws.

Ultimately it is the harmonious functioning of the three organs of the country that can remove procedural barriers to justice. Stating that the Indian judicial system is facing dual challenges, the CJI said the first is that it is necessary to Indianize the justice delivery system.

He said that even after 74 years of independence, the traditional and agrarian societies, which are following the traditional way of life, feel hesitant to approach the courts.

The customs, procedures, language of our courts seem different to them, he said. The common man forgets the fate of his grievance amidst the complex language and process of dispensing justice. In such a situation, a person hoping for justice considers himself an outsider in this system.
